By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Policy and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from Warm Sound Coaching, LLC/JohnWineland.com. Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.

We reserve the right to change these Terms of Service or to impose new conditions on use of the Site, from time to time, in which case we will post the revised Terms of Service on this website. General Information

Entire Agreement

This TOS constitutes the entire agreement between you and Warm Sound Coaching, LLC and JohnWineland.com and shall govern the use of our Services, superseding any prior version of this TOS between you and us with respect to Warm Sound Coaching, LLC and JohnWineland.com. You may also be subject to additional terms and conditions that may apply when you use or purchase certain other services, affiliate Services, or third- party content.

Waiver and Severability of Terms

At any time, should Warm Sound Coaching, LLC and JohnWineland.com fail to exercise or enforce any right or provision of the TOS, such failure shall not constitute a waiver of such right or provision. If any provision of this TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:

limit or exclude our or your liability for death or personal injury resulting from negligence;
limit or exclude our or your liability for fraud or fraudulent misrepresentation;
limit any of our or your liabilities in any way that is not permitted under applicable law; or

To the extent that the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.

Refund Policy

Because our events require meticulous monitoring of the number of attendees, often including masculine/feminine balance, no refunds will be offered within 60 days of the workshop start date. We can offer a 50% refund of the total tuition cost more than 60 days in advance of the workshop or program start date (less any PayPal transaction fees accrued by the Company (including domestic and international payment fees), or transfer your total tuition credit to another workshop or program within the next year. Less than 60 days in advance and until the event start date, if appropriate, we can transfer your total tuition credit to another workshop or program within the next year. If you are on a payment plan, your payments will continue to debit until 50% of your total tuition is paid prior to 60 days of the event start date or payment is in full after 60 days. Any cancellations less than 10 days prior to the event will forfeit full tuition.

All Workshop, Online Programs and Long-Term Programs are subject to force majeure, including but not limited to acts of God, fire, flood, natural disaster, war or threat of war, acts or threats of terrorism, civil disorder, unauthorized strikes, governmental regulation or advisory, recognized health threats as determined by the World Health Organization, the Centers for Disease Control, or local government authority or health agencies (including but not limited to the health threats of COVID-19, H1N1, or similar infectious diseases), curtailment of transportation facilities, or other similar occurrence beyond the control of the parties, where any of those factors, circumstances, situations, or conditions or similar ones prevent, dissuade, or unreasonably delay at least 90 percent of prospective Event attendees from appearing at the Event, or where any of them make it illegal, impossible, inadvisable, or commercially impracticable to hold the Event or to fully perform the terms of the Event Agreement. If any of these circumstances arise The Company will automatically transfer your enrollment to the next workshop within a 1-year period.

Refund Policy: Depth and Devotion, The Path of the Embodied Feminine (Guided Program), The Path of the Embodied Masculine (Guided Program)

These programs are non-refundable and non-transferable unless you notify us in writing at least 30 days prior to the program start date. If you notify us within this time frame, there will be a $150 administrative and transaction fee deducted from your total refund.

Private and Group Programs and Services

All Private or Group programs and Services, including Monthly Auto-Renew Programs, are Non-Refundable and Non-Transferrable unless the company is notified in writing at least 30 days prior to the Program’s start date. When canceled at least 30 days prior, a $150 fee will be deducted to cover admin and processing fees.

If you are a member of a Long-Term Program, including, but not limited to “The Embodied Men’s Leadership Training Program”, “The Embodied Women’s Relationship Immersion”, “The Advanced Practice Group”, “The Teacher Training Program”, the refund policy as stated in your Program Agreement will supersede this refund policy.

Warm Sound Coaching, LLC and all related websites reserve the right to revise the terms of this Refund Policy. Any changes made will apply to all Programs, Products, Services, and Memberships created or renewed after the date such change was implemented.

Masterclass Events

All Masterclass Events are Non-Refundable and Non-Transferrable.

The Virtual Workshop

We created the Virtual Workshop to be a space in which participants can ask deep & vulnerable questions and then work one-on-one with John Wineland. To preserve the integrity of this container and the confidentiality for each participant, please do not record other participants during our Office Hours calls and do not share any photos, videos, and/or recordings online (including personal and/or public websites, Facebook, Instagram, Twitter, YouTube, TicTok, Pinterest, and all other social media outlets). By signing up for The Virtual Workshop, you agree to be held by this confidentiality agreement and agree to enter into a confidential relationship with respect to the disclosure of certain proprietary and confidential information including the teachings of Warm Sound LLC, John Wineland and all personal information that you may become privy to by other Virtual Workshop Participants.

Subscription to The Virtual Workshop is non-refundable. If you need to cancel or pause your membership prior to the next payment, or before your 7-day trial ends, you can view instructions for canceling your Virtual Workshop membership here: https://support.vhx.tv/article/387-how-do-i-cancel-my-subscription.

Be sure to select "Cancel" rather than "Pause" in order to fully cancel your membership. Retroactive refunds will not be offered for lapsed subscription pauses.
